One Step Closer to Justice for Victims of Racist Shooting Spree
Lawsuit Against Gun Manufacturer and Sellers Allowed to Proceed

On April 10, 2002, the Circuit Court of Cook County, Illinois allowed a lawsuit to proceed against the gun manufacturer, distributor and dealer that armed Benjamin Nathaniel Smith, a follower of the white supremacist World Church of the Creator, enabling him to carry out his July 1999 shooting rampage in which he shot 11 people in Illinois and Indiana. The defendants had attempted to evade their responsibility for the shooting by having the case against them dismissed. The court refused to dismiss the case, allowing a claim for creating a public nuisance to go forward against all defendants and a claim for negligence to continue against the dealer.
